In everyday life, people use different words to refer to a trademark: logo, emblem, brand, trademark, trade name, proprietary name, slogan.
Any symbol or a combination of symbols used to identify a product can be a trademark. Such symbols are words, including personal names, letters, figures, graphic elements, colors or their combinations, as well as any combination thereof.
A trademark is protected by law, unless it disrupts social order, violates the principles of humanity and morality, or shall be refused legal protection on the grounds stipulated by the Law of Ukraine “On the Protection of Trademark Rights for Goods and Services».
A natural person or a legal entity (resident or non-resident of Ukraine), an association of persons or their legal successors are eligible to apply for trademark registration certificates.
The amount of legal protection is determined by the image of the trademark and the list of goods and services included in the register.
Time for a verbal trademark registration in Ukraine in the same class is as follows:
- 7 – 8 months: 14 405 UAH (all state fees and services of our agency are included);
- 12 – 24 months: 7 685 UAH (all government fees and services of our agency are included).
Time for a combined trademark registration in Ukraine in the same class is as follows:
- 7 – 8 months: 18 580 UAH (all government fees and services of our agency are included);
- 12 – 24 months: 7 685 UAH (all government fees and services of our agency are included)
Trademark ownership rights are proved by a certificate. A certificate is valid for 10 years from the date of filing an application with the State Enterprise “Ukrainian Institute of Industrial Property” and can be renewed by the same institution at the request of the certificate holder for 10 years at a time, subject to payment of the government charge.
