Domain disputes: recovering and defending domains

A domain with your name has ended up in someone else's hands: it is for sale, a site runs on it under your name, or it just sits empty. We recover such domains through UA-DRP and UDRP, suspend them in the new gTLDs through URS, and where damages are needed, we go to court. First we tell you honestly whether there is a chance.

What people come to us with

  • a domain with your name is listed for sale
  • someone else's site runs under your name
  • the domain is "parked": an empty page with ads
  • a former partner or contractor registered the domain in their own name
  • a complaint has been filed against your domain
  • the domain was stolen or snapped up after the registration expired

How we work

  1. Assessment. We check the three UDRP elements: the domain is identical or confusingly similar to your trademark; the registrant has no rights or legitimate interests in it; the domain was registered and is being used in bad faith. For .UA under UA-DRP, bad faith either at registration or in use is enough. You receive a written opinion with the chances and the risk of the complaint being found to be Reverse Domain Name Hijacking (RDNH).
  2. Demand letter. We write to the registrant on your behalf. Many disputes end here: the domain is transferred or released without a procedure.
  3. Complaint. For .UA — UA-DRP, for .com, .net and other gTLDs — UDRP, for the new gTLDs also URS, when you only need to stop the site. We prepare the complaint and the evidence and handle the correspondence with the Center.
  4. Implementation. After the decision the registrar transfers the domain in 10 working days, unless the registrant has filed a court claim in that time; in a UA-DRP case under martial law the registrant may get up to 14 more days to file it.
  5. Court in Ukraine. Needed when you want damages or the domain falls outside the procedures. Use of someone else's mark in a domain name without the owner's consent is an infringement under Art. 20 of the Law of Ukraine on the Protection of Rights to Marks for Goods and Services. In court a party is represented only by an advocate: the patent attorneys prepare the position and the evidence, the case is run by the advocate on our team. The first instance takes about a year. More on the court protection page.

If the complaint is against you

In UDRP and UA-DRP you have 20 days for the response. We assess the complaint, prepare the response and, where the complaint is clearly groundless, ask the panelist to find Reverse Domain Name Hijacking. More on the respondent defence page.

The registrar and conflicts of interest

The director of Broodex owns the registrar NIC.UA. The registrar takes no part in a domain dispute: it only does what the rules require — confirms the domain's registration data to the Center, locks the domain within two business days and implements the decision. In a dispute we act only as your representative, not as a registrar, and we do not use internal registrar data in a case beyond what the registrar passes to the Center under the procedure. If the disputed domain is serviced by NIC.UA, we tell you at once, before any work starts.

What matters

UA-DRP and UDRP transfer or cancel a domain; URS suspends it. Damages are awarded only by a court.

The WIPO Center fee for a single-member panel (1–5 domains, the same for UDRP and UA-DRP) — $1,500; it is paid separately from our fee.

A three-member panel — $4,000.

We do not take on a weak case. A lost complaint with a finding of Reverse Domain Name Hijacking is a public decision against you, and such findings are growing in number: 86 in 2025 (as of October 2026).

A claim under the US ACPA over a domain at a US registrar is run only through a US-licensed attorney. Broodex Inc. coordinates but does not represent.

Send the domain and the certificate number — we will assess the chances free of charge.
